New York State ALCOHOL BEVERAGE CONTROL LAW
You, your staff, and your business must operate within State Liquor Authority guidelines, or face fines and revocation of your liquor license. Peter will cover these laws during class.
Here's a recap of major provisions of "ABC Law":
- It's an offense to "sell, deliver, or give away" any alcoholic beverage to any person
under 21 under any circumstances.
- It's an offense to employ someone under 18 as a hostess, waiter or waitress, even
if they don't handle alcohol.
- It's an offense to "sell, deliver, or give away" any alcoholic beverage to any visibly
intoxicated person. A person need not be "dead drunk".
- Prohibits restaurants, taverns, hotels, or clubs from selling liquor or wine for
consumption off-premises.
- Prohibits gambling of any type, professional or social, on your premises.
- Prohibits you from allowing disorderly conduct, including: soliciting, brawls,
trafficking in narcotics, and indecent language.
- Prohibits the employment of persons convicted of certain felonies.
- Prohibits the re-use, refilling, or dilution of beverage containers ("only out of the bottle,
nothing in").
- "Last call" is @ 4AM, with all drinks off the bar / tables by 4:30AM. Hours when
alcohol can be served: 8AM - 4AM Mondays thru Saturdays, and noon - 4AM on
Sundays. So many people get this wrong!
Pop question: can you refuse alcohol to a pregnant woman? If you get this wrong,
both the server and business can be fined!
Remember, to the State Liquor Authority, ignorance of the law is not a defense!
